These Terms of Service ("Terms") are a legal agreement between you and YMobilApp ("we", "us", "our") governing your access to and use of all mobile games and applications we publish, including Card Battle: Monster Legends, City Blocks Grid and Color Fill Brain (each, a "Game"). Please read these Terms carefully.
1 Acceptance of Terms
By downloading, installing, accessing or playing any of our Games, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you must not download or use our Games.
Your use of the Games is also subject to the Google Play Terms of Service and any rules of the platform through which you obtained the Game. In the event of a conflict, the platform's terms govern the distribution and payment relationship, while these Terms govern your use of the Game itself.
2 Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use our Games. If you are under the age of majority where you live, you may only use the Games under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
- By using a Game, you represent that you meet these age requirements.
- Parents and guardians are responsible for the activity, purchases and conduct of minors using their device.
3 License to Play
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use one copy of each Game on a device that you own or control, solely for your personal, non-commercial entertainment.
This license does not transfer any ownership of the Games to you. All rights not expressly granted are reserved by YMobilApp and its licensors.
4 Rules of Conduct
When using our Games, you agree that you will not:
- Copy, modify, decompile, reverse-engineer, disassemble or create derivative works of a Game, except as permitted by law.
- Cheat, use bots, automation, hacks, mods, or exploits, or otherwise interfere with normal gameplay.
- Attempt to gain unauthorized access to a Game, our servers, or any related systems or networks.
- Use a Game to distribute malware, spam, or any unlawful, harmful or infringing content.
- Disrupt, overload, or impair the operation of a Game or interfere with other players' enjoyment.
- Remove, obscure or alter any copyright, trademark or proprietary notices.
- Sell, rent, lease, redistribute or commercially exploit a Game or any part of it without our written permission.
- Use a Game in violation of any applicable law, regulation or third-party right.
We reserve the right to investigate and take appropriate action, including restricting or terminating access, against anyone who violates these rules.
5 In-App Purchases
Some Games may offer optional purchases of virtual items or features (for example, removing ads, extra lives, coins or premium content) for real money ("In-App Purchases").
- All In-App Purchases are processed by Google Play Billing; we do not process or store your payment card details.
- Prices are displayed before purchase and may vary by region, currency and taxes.
- Purchases are final. Except where required by law or the Google Play refund policy, In-App Purchases are non-refundable.
- Refund requests are handled in accordance with the Google Play refund policy.
Parents: you can disable or require authentication for purchases in your Google Play account settings to prevent unintended purchases by minors.
6 Virtual Items & Currency
Games may include virtual currency, coins, gems, items, characters, or other virtual goods ("Virtual Items"). You understand and agree that:
- Virtual Items have no monetary value and cannot be redeemed for real money or cash equivalents outside the Game.
- You receive a limited license to use Virtual Items within the Game; you do not own them.
- Virtual Items are non-transferable and non-refundable except where required by law.
- We may manage, regulate, control, modify or remove Virtual Items at any time, with or without notice, and we will have no liability to you for doing so.
- Any unused Virtual Items are forfeited when your access ends or when a Game is discontinued.
7 Advertising
Our Games are free and supported by advertising. By using a Game, you acknowledge and agree that we and our partners may display advertisements, including banner, interstitial and rewarded video ads. Interacting with an ad (for example, tapping it) may take you to a third-party website or store over which we have no control. How advertising data is handled is described in our Privacy Policy.
8 Intellectual Property
The Games and all related content — including software, code, graphics, artwork, characters, names, logos, music, sound effects, text and design — are owned by YMobilApp or its licensors and are protected by copyright, trademark and other intellectual-property laws.
The "YMobilApp" name and logo, and the names of our Games, are trademarks of YMobilApp. You may not use them without our prior written consent. Nothing in these Terms grants you any right to use our intellectual property except as strictly necessary to play the Games.
9 User Content & Feedback
If you submit feedback, suggestions, ideas, bug reports or other materials to us ("Feedback"), you grant YMobilApp a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify and incorporate that Feedback for any purpose, without any obligation or compensation to you.
You are solely responsible for any content you submit and represent that it does not infringe the rights of any third party.
10 Third-Party Services
Our Games may use or link to third-party services (such as advertising networks, analytics providers, and the Google Play platform). We are not responsible for the content, policies, availability or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.
11 Updates & Availability
We may release updates, patches, new features or bug fixes for our Games from time to time. Some updates may be required for continued use, and your device may need to meet minimum hardware or software requirements.
- We do not guarantee that any Game will always be available, uninterrupted, error-free or compatible with every device.
- We may modify, suspend or discontinue a Game (in whole or in part) at any time, with or without notice, and without liability to you.
12 Termination
These Terms remain in effect while you use our Games. We may suspend or terminate your access to a Game at any time, without notice, if you violate these Terms or if we discontinue the Game.
You may end this agreement at any time by ceasing to use and uninstalling our Games. Upon termination, the licenses granted to you end immediately, and any Virtual Items or progress may be lost. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.
13 Disclaimers
To the maximum extent permitted by law, our Games are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Games will meet your requirements, be secure, or operate without interruption or error, or that any defects will be corrected. You use the Games at your own risk.
14 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall YMobilApp, its owners, employees or partners be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses arising out of or relating to your use of (or inability to use) our Games.
To the extent that liability cannot be excluded, our total aggregate liability to you for all claims relating to the Games shall not exceed the greater of (a) the amount you actually paid to us for the relevant Game in the twelve (12) months before the claim, or (b) USD $10.00.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In such cases, our liability is limited to the smallest amount permitted by law.
15 Indemnification
You agree to indemnify, defend and hold harmless YMobilApp and its affiliates, owners, employees and partners from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Games, your violation of these Terms, or your infringement of any third-party right.
16 Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws applicable at the place of YMobilApp's principal establishment, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Games will be subject to the exclusive jurisdiction of the competent courts of that location, unless mandatory local consumer-protection law grants you a different forum.
Nothing in these Terms limits any mandatory statutory consumer rights that apply to you and that cannot lawfully be waived.
17 Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide notice within a Game. Your continued use of our Games after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Games.
